While it is true that any employer can terminate any employee at any time, unless there is “just cause” for the termination an employee who is terminated is entitled to compensation.

The type and amount of compensation will depend on the particular circumstances but can include: severance pay, payment in lieu of notice, payment for benefits or pensions and even punitive damages.

There are minimum standards with respect to the compensation that an employer must pay to a terminated employee. Many times employers will offer to pay something more than the minimum standards in an effort to convince the employee to accept a settlement without consulting with a lawyer. It is important to understand that the law often entitles an employee to more than the minimum standards and it is important for you to obtain your own legal advice.
